Terms of Use

Effective October 12, 2026

These Terms govern your use of SuperPresence (“SuperPresence,” “we,” “our,” or “us”): the app at superpresence.app, the websites, content and posts it creates and publishes for you, the review requests it sends for you, and related services (the “Services”). If you do not agree with these Terms, do not use the Services. Our Privacy Policy explains how we handle information.

Our role

SuperPresence is a technology provider: we make tools that help professionals present and market their business. We are not a real estate brokerage, law firm, accounting firm, financial or insurance adviser, or any other licensed professional. We do not give professional advice, represent anyone in a transaction, or take part in the services you provide to your clients.

You are responsible for holding the licenses your work requires and for following the rules that apply to your profession and its advertising, such as showing your license number or your brokerage’s name where required. Websites made with SuperPresence may say that they are powered by SuperPresence and that SuperPresence is a technology platform, not your firm.

Eligibility and accounts

You must be at least 18 and able to enter a binding agreement. Keep your account details accurate and your password private; you are responsible for activity under your account. We may limit access to the Services or to particular features.

Your content

You keep ownership of the content you add, link to or import (photos, listings, portfolio, testimonials, text, documents, logos and other materials) and of the websites, blog content and posts you create. You grant us a license to store, process, adapt, display and publish that content as needed to provide the Services, including on your website and on the social accounts you connect. You confirm you have the rights and permissions to use everything you add, including photos of properties and people, testimonials, and content imported from other sites.

AI-generated content

The Services use AI to draft your website, blog content, posts, review requests and designs. AI output can be inaccurate. Review it before you publish or send it; you are responsible for what you publish and send, including compliance with advertising, real estate and fair housing rules and the rules of your profession.

Scheduling and publishing to your accounts

When you connect Facebook, Instagram, LinkedIn, your Google Business Profile or another platform, you authorize us to publish the content you schedule to those accounts. Scheduled content is published automatically at the times shown in your calendar; you can change or cancel it before it goes out. Your use of those platforms is governed by their terms and policies. Platforms may change or limit their services, which can delay or prevent publishing; we will tell you when a post fails.

Review requests

You choose who receives review requests and you confirm that each person is your customer and has given any consent the law requires for you to contact them by email or text message. You agree to follow the laws and platform policies that apply to reviews, including not offering anything in exchange for a review, not asking only satisfied customers to review you in a way those policies prohibit, and not posting or requesting fake reviews. Recipients can opt out, and we will not send them further requests from you.

Your website and leads

Websites you publish are public. Messages and requests that visitors send through your website are delivered to you; you are responsible for how you respond to and use them, including any consent required to contact people.

If you visit a website made with SuperPresence, your dealings are with the professional who publishes it, not with us. Our Privacy Policy explains how we handle what you send through it.

Domains

If you get a custom domain through us, it is registered with you as the owner. Registration is subject to the registrar’s terms. If your access to custom domains ends, we may stop paying renewals; you keep the domain and can transfer it.

Acceptable use

You agree not to:

  • infringe anyone’s intellectual property, privacy or publicity rights;
  • publish content that is unlawful, misleading, harassing or discriminatory;
  • use the Services to send spam or contact people without the consent the law requires;
  • attempt to gain unauthorized access to our systems or interfere with the Services;
  • use automated means to access the Services except through features we provide.

We may remove content or suspend accounts that violate these Terms.

Fees

Some features may require a paid plan. Prices, billing terms and any renewal and cancellation terms are shown before you buy, and you choose whether to subscribe.

Our intellectual property

We own the Services, including the software, templates and designs we provide. We grant you a limited, non-exclusive, non-transferable license to use them for your own business while you follow these Terms.

Copyright complaints

If you believe content on the Services infringes your copyright, email [email protected] with the material and your contact details. We may remove it and take other action as appropriate.

Termination

You can stop using the Services at any time. We may suspend or end your access if you violate these Terms or if we discontinue the Services. Sections that by their nature should survive (ownership, disclaimers, limitation of liability, indemnification) survive termination.

Disclaimers

The Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. The Services may be interrupted or contain errors. We do not guarantee any particular ranking or visibility in search engines, AI assistants or maps, or any number of visitors, leads, reviews or customers; these depend on many factors outside our control.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business. Our total liability for any claim related to the Services will not exceed the amount you paid us in the six months before the claim arose.

Indemnification

You agree to defend and indemnify us against claims arising from your content, your use of the Services, your violation of these Terms, or your violation of any law or third-party right.

Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. Please contact us first to resolve any dispute informally; otherwise, disputes will be brought in the state or federal courts located in Delaware.

Changes

We may update these Terms. We will post the new version here and notify you of significant changes; continuing to use the Services means you accept them.
